Legal Fees for Debt Collections

Not all debt collection cases are the same. Variables include but are not limited to the following:

Size of debt to be collected
   
Legal defenses available to the debtor. See California Homestead Exemptions.
   
Whether a court judgment already exists or must be obtained by prevailing in a lawsuit.
   
The likelihood of locating non-exempt assets once a judgment is obtained.
The possibility that the debtor will file for protection under the bankruptcy laws.
   
Whether the debtor is an individual, partner, corporation, LLC or otherwise.
   
Whether the debtor was a qualified Accredited Investor.
   

Depending upon the factors set forth above and others, Michael T. Chulak & Associates will represent creditor clients for compensation based on one of the following alternatives:

Full contingency representation where the client pays a percentage of the actual money received and out of pocket costs. Some out of pocket costs may be advanced by our firm depending on the case;
   
Reduced contingency fee plus a reduced hourly rate, with the client paying out of pocket costs;
A maximum amount of cash payment deposited into our attorney trust account to be applied as legal work is done. This maximum cash amount is then credited against a percentage of recovery fee; or
   
Hourly billing payable against a deposit with the client paying out of pocket costs.
   

 

Fifteen ways to Collect a Court Judgment

1. Place a lien on real property owned by the debtor.
   
2. Place a lien on business property owned by the debtor.
   
3. Conduct a debtor's examination under oath at the court where the judgment was entered.
   
4. Conduct a debtor's examination under oath of the debtor's clients or customers at the court where the judgment was entered.
   
5. Garnish or seize the debtor's wages.
   
6. Seize (levy on) bank or savings accounts owned by the debtor.
   
7. Have a sheriff collect from a business debtor's cash register (till tap).
   
8. Have a sheriff collect funds from a business as it is received from customers (keeper).
   
9. Seize and sell business assets of the debtor.
   
10. Levy on (collect) debts owed to the debtor by third parties.
   
11. Seize and sell the debtor's vehicle if not exempt.
   
12. Seize and sell non-exempt personal assets of the debtor such as art and jewelry.
13. Obtain a court order requiring the debtor to turn over specific personal property.
   
14. Obtain a court order requiring the debtor to transfer or assign certain rights such as rents or royalties.
   
15. Force the sale of real property owned by the debtor.
